The Cheer Project service and network (collectively, “The Cheer Project” or “The Service”) are operated by Darrouzet Mendieta Group, LLC and its corporate affiliates (collective, “us”, “we”, or “The Company.”) By accessing or using the web site www.thecheerproject.com or www.cheerproject.com or by posting a Share Button on our site, you (“the User”) signify that you have read and understand the and agree to be bound by these Terms of Use, whether or not you are a registered member of the Cheer Project. We hold the right to add, change, or delete any part of this agreement at anytime. Any changes of this of this agreement will posted on the terms, the use of the site after the posted dates will assume that you acceptance of the new terms. • This site is solely intended for the communication and promotion of cheerleading as an athletic sport. All accessing users or members shall meet all criteria before uploading and communication is established.

• The site is intended for users who are twelve (12) years of age or older, and users who are currently, previously or aspire to be part of a cheerleading program.

• Users under the age of twelve (12) are required to be assisted by parental guidance during the use and all of the website’s functionality. Additional requirements are required the users for uploading pictures, video and audio.

• By becoming a member of this site, you acknowledge that of your registration information is true to the best of your knowledge.

• The Cheer Project will maintain the security of your user name, password and identification.

• The Cheer Project reserved the right to monitor account activity at any time if suspicious activity is assumed during communication and uploads.

• All the content on the Site and available through the Service, including designs, text, graphics, pictures, video, information, applications, software, music, sound and other files, and their selection and arrangement (the “site” content), are the propriety property of the Company, its users or its licensors with all the rights reserved.

• No sections of the site will be copied, published, modified, reproduced, posted or sold in any form by the means of whole or part, without the Company’s prior written permission, except the foregoing applies to the User content.

• All members shall abide by the user conduct laws that are produced for The Cheer Project.

• All registration setup is to be done by the User, or for the User (in the case of ages 12 and under). You may not set up an account on behalf of another individual or entity unless you are authorized to do so.

• Users agree to not use the site to collect or harvest email address or other personal information from other users from the Service or the Site by electronic means of sending unsolicited emails or unsolicited communications.

• Members agree to upload, post transmit, share, store content that is in the promotion of cheerleading. Members shall not upload, chare, store content that is harmful, threatening, unlawful, defamatory, infringing abusive, inflammatory, harassing, vulgar, obscene, fraudulent, hateful, or racial, ethnically or otherwise objectionable.

• Members shall not share account information or use or sign on as another Member.

• Members will not share, upload or store otherwise make available content about the Company which inhibits and restricts other Members from using and enjoying the site, or which may expose the Company or its users to harm or liability of any type.

• As a Members of the Site, you are sole responsible for the photos, profiles, message, notes, text, information, music, video and other content that you upload , publish or display through our Site or Service, or transmit to share with other Members of the site.

• All uploads must be created by the Member, and all media should be within the permission of the User.

• With multiple infractions to the terms of the use, The Cheer Project reserves the right to delete and restrict your profile and access to our site.

• The Cheer Project is not responsible for the loss of data through the site content. The Members are responsible for creating backup copies for their own personal use.

• Through The Cheer Project site, you are granted the power to receive posted messages directly to your text message service through your telephone.

• The Company is not responsible for applicable charges associated with your mobile phone company or the text messages received through the Cheer Project site.

• The Company offers a service whereby users of the Site can share with other or post to their own member’s profiles, videos, articles and other Third Party Applications, Software or Content from, and/or links to, Third Party Sites through the Service (the “Share Service”). You acknowledge that you met all of the user code s of conducts and you agree to all of the Membership regulations.

• As a Member of The Cheer Project, you are entitled to access collegiate coaches across the country. This service is a valuable part of the Company. All Members will be given the opportunity to be contacted from coaches during the Membership registration. This feature doesn’t not guarantee the communication of college coaches. Does place you as the User into a pool of prospective candidates for college coaches.

• The Cheer Project is not responsible for the acquisition of collegiate scholarships. • The User is responsible for your interactions with other Cheer Project users. We reserve the right, but have no obligation, to monitor the disputes between you and other users.

• The Company is not responsible or liable in any manner for any User Content or Third Party Applications, Software or Content posted on the Site or in connection with the Service, whether posted or caused by users of the Site, by The Cheer Project, or by third parties or by any of the equipment or programming associated with or utilized in the Site or Service. Although we provide rules for user conduct and postings, we do not control and are not responsible for what users post, transmit, share on the site and we are not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content you may encounter on the site or in connection with any User Content or Third Party Applications, Software or Content.

• The Company is responsible for conduct, whether online or offline, of any user of the Site or Service.

• The Company reserved the right to be temporarily unavailable for maintenance and service to the site. The Company is not responsible for the deletion, omission, error, communication line failure, and alteration due to maintenance or servicing. These terms of Use constitutes the entire agreement between you and the Company regarding the use of the Site and/or Service, superseding any prior agreements between you and the Company relating to your use of the Site or the Service.
